Proposed Revisions to Clean Air Markets Programs and Rules

US EPA is proposing revisions to 40 CFR Part 75 and Part 72.2, and has posted Notice of Proposed Rulemaking: Revisions to the Continuous Emissions Monitoring Rule for the Acid Rain Program, NOx Budget Trading Program, the Clean Air Interstate Rule, and the Clean Air Mercury Rule (pdf, 232233pp., 864865kB; revised 8/15/2006). The proposed revisions reflect changes being implemented by US EPA's Clean Air Markets Division in its data systems in order to utilize Extensible Markup Language (XML) files for the submittal of data by affected sources. Other revisions address issues that have been raised during program implementation, fix specific inconsistencies in rule provisions, or update sources incorporated by reference.

US EPA is also proposing to expand the definition of excepted monitoring systems to include the sorbent trap and low mass emissions (LME) excepted methodologies for Hg. In addition, the proposed rule would add definitions of 'Air Emission Testing Body' (AETB) and 'Qualified Individual' to support the proposed stack tester accreditation program (see ASTM D7036-04 Standard Practice for Competence of Air Emission Testing Bodies).
